These terms are arranged in the order you'll meet them: before you order, at checkout, in the minutes after, while the package travels, when it arrives, and in the 30 days that follow. The last section covers the rules that apply the whole time. They govern every purchase from Opera LLC through operanewyork.com, together with our Shipping Policy, Returns & Refunds Policy, Payment Policy and Privacy Policy. Where a summary here differs from one of those policies, the policy governs. By placing an order you accept these terms.

Stage 1: Before you order

1.1 Who you're buying from. The store "Opera" at operanewyork.com is operated by Opera LLC, 90-15 Queens Boulevard, Elmhurst, NY 11373, United States. Email: support@operanewyork.com. Phone: +1 (718) 592-3900. Customer service hours: Monday–Friday, 9:00 AM–5:00 PM ET; Saturday and Sunday closed; replies within one business day. The store runs on Shopify, which provides the platform and checkout; your contract is with Opera LLC alone.

1.2 Who can order. You must be 18 or older to place an order; a parent or legal guardian orders for anyone younger. Guest checkout is available and an account is optional. The name, address and email you give must be accurate and current, because we rely on them to deliver your order and can't change them once the order is processing (see Stage 3). We sell to consumers for personal use and may decline or limit orders that appear to be for resale.

1.3 Product information. We take care to describe each piece accurately: fabric composition, garment measurements, fit, care. Colors may vary slightly between screens and measurements are approximate. If a detail matters to you, ask before ordering. Range, prices and availability can change without notice. If we discover an error in a description or price after you've ordered, we'll tell you and you can keep the order at the correct terms or cancel it for a full refund.

1.4 Prices. Prices are in US dollars. Sales tax, where it applies, is calculated from your shipping address and shown at checkout before you confirm. Shipping is free. If an order ships from a fulfillment center outside the United States, import duties and fees are paid by us; nothing is collected on delivery. The price that applies is the one shown when you place the order and in your confirmation email. An obvious pricing error, such as a missing digit, doesn't bind us.

1.5 Promotions and discount codes. Codes are entered at checkout and can't be applied afterward. One code per order unless the promotion says otherwise; codes have no cash value. If you return an item bought with a code, we refund what you actually paid.

Stage 2: At checkout

2.1 Your order and our acceptance. Listing a product is an invitation to order, not a binding offer. Completing checkout is your offer to buy. The automatic confirmation email records that we've received the order; the contract is formed when we send the shipping confirmation. Until then we may decline an order if an item is out of stock, payment can't be authorized, a price or description was wrong, the address is incomplete or undeliverable, or we have reason to suspect fraud. Any amount already charged is refunded in full.

2.2 Payment. Payment is taken when you place the order, by any of the methods shown at checkout; they're listed in our Payment Policy. Card details go directly to the payment provider and never reach our systems. By paying you confirm you're entitled to use that method. Orders may pass through reasonable fraud checks, and a declined or reversed payment may result in cancellation.

2.3 Shipping Protection. Shipping Protection is an optional service you can add at checkout. It covers your package against loss or damage in transit, as described at checkout; in those cases we send a replacement free of charge. The fee is non-refundable once the order has shipped, including if you later return the order or part of it. It is refunded only when an order is canceled within the 5-minute window in Stage 3.

Stage 3: The first five minutes

3.1 Canceling or changing an order. Every order is transmitted to the fulfillment center automatically and enters processing within minutes. An order can therefore only be canceled or changed within 5 minutes of being placed. To cancel, email support@operanewyork.com with your order number and "CANCEL" in the subject line; the time your email reaches us is what counts, and we confirm every cancellation in writing. Requests that arrive later can't be processed as cancellations, whatever the reason, and are answered with our return instructions instead.

3.2 Address errors. The same applies to the shipping address, size and color: they can be corrected within 5 minutes and not afterward. If a package comes back to us as undeliverable because the address you gave was wrong or incomplete, Stage 4.4 applies.

Stage 4: While your order is on its way

4.1 Delivery estimates. Processing takes 1 to 3 business days and delivery 3 to 5, so 4 to 8 business days in total; during sales and the November–December peak, processing can take up to 2 additional business days. These are estimates based on carrier performance, not guaranteed dates. If we're unable to ship within the time stated, or within 30 days where none is stated, we'll tell you and you can agree to a new date or cancel for a full refund, as the FTC Mail, Internet, or Telephone Order Merchandise Rule provides. A delay within or shortly beyond the estimate isn't a defect and isn't a ground for cancellation.

4.2 Tracking and lost packages. Every order is tracked. The first scan can take 24 to 48 hours. If tracking shows no movement for 10 business days, email us and we open an investigation with the carrier; once the carrier confirms the loss, we send a replacement. If tracking shows "delivered" but you have nothing, check with household members, neighbors and the building's package area, then email us within 3 business days of the delivery scan so we can start the carrier's process.

4.3 Risk of loss. Risk passes to you when the carrier records delivery at the address you gave. Until then, loss or damage in transit is ours to resolve under 4.2 and Stage 5.

4.4 Refused, unclaimed and undeliverable packages. Refusing a package or not collecting it doesn't cancel the order. A package returned to us for those reasons, or because the address you gave was wrong or incomplete, is refunded minus the carrier's return costs once it reaches us, or reshipped for a new shipping fee if you prefer.

Stage 5: At your door — the first three business days

5.1 Check the order. Open the package and check the items on arrival.

5.2 Damaged, defective, wrong or missing. Email us within 3 business days of delivery with your order number and photos of the item, the packaging and the shipping label. We need the photos within this period because the carrier's claim window is just as short; we're unable to accept claims without photos or after 3 business days. A confirmed problem is resolved by sending a replacement free of charge.

5.3 What isn't a defect. Loose threads, a small open seam of about an inch that closes in a minute, a fit that isn't what you expected, and a color or style you don't like aren't defects. Sizing and taste are what the return window in Stage 6 is for.

Stage 6: The 30 days after delivery

6.1 Returns. You may request a return within 30 days of the delivery date recorded by the carrier. Every return needs our written approval before anything is shipped; returns sent without approval, or to our business address, can't be refunded. Items come back unworn, unwashed and undamaged, with all tags and original packaging, and are inspected before a refund is issued.

6.2 Return shipping. Returns go to our returns center in the United Kingdom, an international shipment arranged and paid by you with a tracked service. We don't provide return labels, free returns or exchanges; if you'd like a different size, return the item and place a new order.

6.3 Refunds. Approved refunds go to the original payment method within 7 business days of approval. Shipping Protection fees aren't refunded. If an item comes back worn, washed, damaged or without its tags, we may decline the refund or refund a reduced amount.

6.4 Fair use. Where we see repeated returns of worn or used items, claims that aren't supported by photos, or returned items that differ from those purchased, we may decline the return and refuse future orders.

6.5 New York disclosure. In line with New York General Business Law § 218-a, our full refund policy is published on our Returns & Refunds Policy page and is available before you buy.

At all times

7.1 Site content. The Opera name, logo, site design, photography, graphics and text belong to Opera LLC or its licensors and are protected by copyright and trademark law. You may browse and shop; copying, republishing or commercial use of any content requires our written permission.

7.2 Reviews and submissions. Anything you send us (a review, photo, comment) stays yours, but you grant us a royalty-free, non-exclusive, perpetual right to use, edit, translate and publish it for our business purposes. It must be your own, reflect your genuine experience, and contain nothing unlawful, defamatory or malicious. We may decline to publish or remove submissions and aren't obliged to keep them confidential or pay for them.

7.3 Acceptable use. Don't use the site to break the law, infringe anyone's rights, submit false information, spread malicious code, collect other people's information, send spam, scrape without permission, or interfere with its security. We may suspend or end access for a material breach; accepted orders are still fulfilled.

7.4 Third-party links and availability. The site may reference services run by others; we aren't responsible for their content or practices. We may change, suspend or discontinue any part of the site and can't guarantee uninterrupted availability. None of this affects an order we've already accepted.

7.5 Privacy. Our Privacy Policy explains what we collect, why, who receives it, and your rights, including under the New York SHIELD Act and the consumer privacy laws of your state.

7.6 Liability. The site is provided "as is", and we don't guarantee it will always be available or error-free. Our total liability in connection with an order is limited to the amount you paid for it, and we aren't liable for indirect, incidental, consequential or special loss. These limits don't apply to fraud, to personal injury caused by our negligence, or to any liability that can't be excluded by law. Some states don't allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits rights you have under New York General Business Law §§ 349 and 350, the implied warranty of merchantability, or the consumer protection laws of your own state that can't be waived.

7.7 Indemnity. If your breach of these terms or of the law, or your infringement of someone's rights, leads to a claim against Opera LLC, you agree to cover our reasonable costs of dealing with it, including reasonable attorneys' fees. We'll tell you about any such claim and give you a chance to respond before settling.

7.8 Changes, assignment, severability. We may revise these terms; the current version is on this page with the date above, and changes don't apply to orders already placed. We may assign our rights and obligations to another company provided your rights aren't reduced; you may not assign yours without our consent. If a provision is unenforceable, the rest remain in force, and not enforcing a provision once doesn't waive it.

7.9 Governing law and disputes. Contact us first: nearly every issue is settled by email. These terms and any purchase are governed by the laws of the State of New York and applicable federal law, without regard to conflict-of-law rules. Disputes that can't be resolved by email are heard in the state courts located in Queens County, New York, or the United States District Court for the Eastern District of New York. That doesn't prevent you from bringing a claim in the small claims court where you live or from relying on the consumer protection laws of your own state.
