This policy is built around a table. For each kind of information we hold, it says where it comes from, what we use it for, who else sees it, and how long we keep it. Below the table are the parts that don't fit in a cell: cookies and advertising, your rights, security, and children.

Who is responsible

Privacy questions and requests: support@operanewyork.com, with "Privacy request" in the subject line. We reply within one business day, Monday to Friday, 9:00 AM–5:00 PM ET.

We don't collect sensitive information such as government identifiers, health information or precise location, and we don't need it. We don't knowingly collect information from anyone under 18 (section 6).

2. Cookies and advertising

Cookies and similar technologies fall into three groups. Necessary cookies run the cart, checkout and security and can't be switched off. Analytics cookies tell us which pages are visited and where the site is slow. Advertising cookies and pixels let advertising platforms show you our products after you've visited, and measure whether an ad led to a purchase.

Where your state's law treats sharing browsing data with advertising platforms as a "sale" or "sharing" of personal information, or as targeted advertising, you can opt out in three ways: through the cookie settings shown when you first visit, through the "Do not sell or share my personal information" option in the site footer, or by turning on the Global Privacy Control signal in your browser, which we honor automatically. Opting out doesn't affect orders or customer service. We don't sell personal information for money.

Analytics and advertising cookies last up to 26 months; necessary cookies last for the session or up to one year. You can also delete cookies in your browser at any time.

3. Email and text messages

Order confirmations, shipping updates and replies to your emails are sent to anyone who orders; they're part of the service and can't be unsubscribed from while an order is open. Marketing emails are sent only if you opted in at checkout or signed up, and every one carries an unsubscribe link that works within 10 business days as the CAN-SPAM Act requires (in practice, immediately). Text messages are sent only with your separate express consent, as the TCPA requires; reply STOP to end them, and message and data rates may apply. We never make your consent to marketing a condition of buying.

4. Who else receives your information, and where

The service providers in the table act on our instructions: Shopify as our store platform, the payment providers shown at checkout, the fulfillment center and carriers, our returns center in the United Kingdom, email and SMS tools, and analytics and advertising platforms. We also disclose information when the law requires it, to protect against fraud, or as part of a sale or reorganization of the business, in which case this policy continues to apply.

Your information is processed in the United States. Some of our providers and team members operate from other countries, including the United Kingdom, so your information may be accessed from there under contracts that require the same level of protection.

5. Your rights

Whatever state you live in, you can ask us to: tell you what information we hold about you; correct it; delete it; give you a copy in a portable format; and stop using it for marketing or targeted advertising. Residents of states with comprehensive privacy laws, including California (CCPA/CPRA), Virginia, Colorado, Connecticut, Texas, Oregon and others, have these rights in law, and we apply them to everyone. Email support@operanewyork.com with "Privacy request" in the subject line. We verify requests by matching the email address and, where needed, an order number, and respond within 45 days. We never treat you differently for exercising a right, and an authorized agent may act for you with your written permission. We keep order records needed for tax, accounting and fraud prevention even after a deletion request, and tell you what we've kept and why.

Under the California CCPA, in the preceding 12 months we have collected the categories of information listed in the table and have "shared" device and browsing data with advertising platforms for cross-context behavioral advertising. We have not sold personal information and have no actual knowledge of selling or sharing the information of consumers under 16.

6. Children

Our store is for adults. We don't knowingly collect personal information from anyone under 18, and never from children under 13 as defined by COPPA. If you believe a minor has given us information, email us and we'll delete it.

7. Security

We follow the reasonable administrative, technical and physical safeguards the New York SHIELD Act (General Business Law § 899-bb) requires: encrypted connections, access limited to staff who need it, a payment provider that handles card data so we never hold it, and regular review of who has access to what. If a breach affects your private information, we'll notify you and the relevant authorities as General Business Law § 899-aa requires.

8. Changes

We may update this policy as our services or the law change. The current version is always on this page with the date at the top. Material changes to how we use information already collected will be announced on the site or by email before they take effect.
